Recell Consignment Terms & Conditions

Welcome to Recell!

These terms and conditions ("Terms") apply to all pre-owned tech devices ("Devices") you ("Consignor") consign to Recell ("Company") for sale. By consigning a Device to Recell, you agree to these Terms.

Delivery & Risk of Loss:

  • You deliver Devices on a consignment basis.
  • Risk of loss or damage transfers to Recell upon physical possession.
  • You retain risk of loss or damage during transit to Recell.
  • Recell will compensate you for the net value (sale price minus commission) if a Device is lost or damaged in our possession.

Acceptance & Condition of Devices:

  • We accept Devices in good working condition and deemed sellable.
  • We thoroughly examine Devices for authenticity and condition upon receipt.
  • A fee may apply to incomplete Devices (e.g., missing original box).
  • Counterfeit items will be rejected.

Consignment Period:

  • The initial consignment period is 30 days.
  • You can extend the period or collect your Device after 30 days (see "Return of Goods").
  • A processing fee may apply for Device collection within 30 days.

Selling Efforts & Pricing:

  • We display Devices online and in-store for sale.
  • We use reasonable efforts to sell your Device.
  • Customers may try on or use Devices for evaluation purposes.
  • We reserve the right to categorize and transfer Devices between locations for optimal sales opportunities.
  • We will discuss and advise on a competitive selling price, but you set the final price.
  • You will be notified of any offers below the asking price and have the final decision to accept or reject.

Title to Goods:

  • You retain ownership of the Device until it's sold, lost, stolen, or damaged in our possession.

Payment & Commissions:

  • Upon Device sale, you receive the selling price minus the following commission:
  • Phones: [22%]
  • Tablets: [25%]
  • Laptops: [30%]
  • This is your sole compensation under this agreement.
  • Payments are processed electronically every Thursday for sales between the previous Monday and Sunday.
  • You will be notified of the sale and payout date.

Return of Goods:

  • A withdrawal fee may apply if you collect your Device before the consignment period ends.
  • No fee applies after the period ends.
  • You cannot retrieve your Device until all fees are paid.
  • Recell covers the cost of returning transferred Devices.

Termination:

  • Either party can terminate this agreement with written notice.
  • Costs mentioned under "Return of Goods" will still apply.

Representations, Warranties, & Indemnification:

  • You warrant ownership of the Device, free from liens or encumbrances.
  • You warrant the Device does not infringe on any intellectual property rights or violate any laws.
  • You agree to indemnify Recell from damages, lawsuits, and costs arising from your Device.

Governing Law & Jurisdiction:

  • These Terms are governed by the laws of [Your Country], excluding its conflict-of-law provisions.
  • Any disputes will be settled in the courts of [Your City, Country].

Waiver & Severability:

  • A party's failure to enforce a Term does not waive future enforcement.
  • If a Term is found to be invalid, the remaining Terms remain enforceable.

Headings:

  • Headings are for convenience only and do not affect the meaning of these Terms.

Resetting your Device:

  • Reset your Device before sending us your device,Recell will not be liable for any stolen or lost information.

Acceptance:

By consigning a Device to Recell, you acknowledge that you have read, understood, and agreed to these Terms.
